On this day, the Oil Company Yukos became frightened of court action

Business reputation of a fraudulent tax dodger. 200 billion rubles of tax arrears. The website Prigovor.ru reminds its readers of what happened on March 2, 2004 and 2005.

On this day, on March 2, 2004, unexpectedly, recalled its complaints against the Russian Ministry of Taxes and Levies filed within the framework of the claim about the “defense of business reputation”. The Oil Company Yukos argued that “the disseminated by the Ministry information about the Yukos violations of tax laws, does not correspond to reality, besmears it and inflicts damage to the business reputation of the company”. However, on the eve of the hearing of the case, the press service of the Moscow Arbitration Court said that Yukos recalls its claim, and the hearings will be devoted to the question of the termination of the proceedings on the case “in connection with the recall of the statement of claim”.

The claim to the Arbitration of the Russian capital was filed by Yukos as early as in January 2004, after Khodorkovsky’s oil empire had received official materials of the Tax Service, from which it followed that Yukos, taking into account penalties and fines, owed to the state budget billions of rubles. As bravely told Alexander Shadrin, the press secretary of the company, Yukos filed the complaint demanding that the Ministry for Taxes and Levies and Igor Golikov (he signed the documents being the deputy head of the Ministry) should refute the statement of the Ministry, directed to the Office of the Prosecutor General, about non-payment of the company of taxes to the state budget to the amount of 150 billion rubles”.

“The company”, assured Shadrin, “presented to the court all documents in which it is stated that Yukos has no tax liabilities”.

Yet, as it came to the real hearings of the case in the arbitration proceedings, it turned out that Yukos simply had nothing to defend within the framework of “good reputation of a tax payer”.

And in a year, everything became clear – Yukos had a solid place in the registry of “fraudulent tax dodgers”.

HELD OUT ON THE STATE 200 BILLION RUBLES

So, , on March 2, 2005, the Arbitration Appeal Court of Moscow refuted the claim of Yukos confirming the ruling of the court on the legitimate character of recovering from the company tax penalties for 2002 to the tune of more than 72 billion rubles. The court also confirmed the decision of the Arbitration of Moscow from December 16, 2004, on legality of actions of the Federal Tax Service of the Russian Federation which had levied tax, penalties and fines on Yukos for 2002 to the amount of about 200 billion rubles.

On the whole, taxmen charged on Yukos for 2002 the taxes to the tune of 90.2 billion rubles, fines – 31.4 billion rubles, and penalties – more than 72 billion rubles. The penalty sanctions of the Federal Tax Service were recovered through court, and the main part of the taxes and fines were withdrawn in the extra judicial procedure.

Apart from that, on February 21, 2005, the Arbitration Appeal Court of Moscow refuted the Yukos complaint and confirmed the legality of writhing off in the extra judicial procedure taxes and fines exceeding 120 billion rubles.

The former press-secretary of Yukos Alexander Shadrin died in January 2021. The newspaper “Kommersant”, where he once had worked as deputy editor, published an obituary: “One of the founders of the Russian business journalism and business communications died, he was 50 years old”, notes the website Prigovor.ru.
